PackBaby is a trading name of James McRae, a sole trader based in Scotland.
In these terms, "we", "us" and "our" mean James McRae trading as PackBaby, and "you" means the person using PackBaby. These terms are the agreement between us for your use of the PackBaby website and service. By using PackBaby you accept them. Please read them alongside our Privacy Policy and our Refund & Cancellation Policy, which forms part of these terms.
These terms are written in English and are only available in English.
PackBaby asks you about your child and your trip and calculates a suggested suitcase list and a separate journey-bag list, which you can generate, save, print and copy.
Please understand the limits of what that is:
Nothing in this section limits our responsibility for the service itself being provided with reasonable care and skill, or any of your statutory rights.
You can use PackBaby as a guest, in which case your trips are saved only in your own browser. If you want your trips saved to your account and available on other devices, you can create an account.
The current plans and prices are shown on the PackBaby home page. At the date of these terms they are:
One active trip, the smart packing list, and print or save-as-PDF. Once you have saved that trip, its details are locked: you can keep viewing, printing and copying the list, but you cannot change the trip's details or save a different trip without buying a Trip Pass or PackBaby+.
A one-off payment that covers one trip. The trip it covers stays fully editable: you can change its details and re-save it as often as you like, with no limit on the number of edits. A Trip Pass applies to that one trip only — it does not unlock additional trips, and buying another trip requires another Trip Pass or PackBaby+.
An annual subscription that removes the one-trip limit, so you can create, edit and save as many trips as you like for as long as the subscription is active, and gives access to premium tools we add to the plan in future. Features described as future or planned are not part of what you are buying today, and we do not promise a date for them.
We describe on the home page and here only what PackBaby actually does today. If a plan's contents change, we will update this page.
You have a legal right to change your mind about a digital purchase within 14 days, and separate legal rights if what you bought is faulty or not as described. You can also cancel a PackBaby+ subscription at any time to stop it renewing.
How all of that works, and how to ask, is set out in full in our Refund & Cancellation Policy. To cancel or ask for a refund, email support@packbaby.co.uk.
The trip details you enter stay yours. You give us permission to store and process them only so far as we need to in order to run the service for you — generating your lists, saving your trips and showing them back to you. We do not use your trip content for advertising and we do not sell it.
You can ask us to delete your account and its saved trips at any time by emailing support@packbaby.co.uk. How we handle personal information, and the rights you have over it, are explained in our Privacy Policy.
You are responsible for keeping your own copy of anything you need to rely on. PackBaby offers print and copy features for exactly that reason, and we recommend using them for a trip that matters.
The PackBaby name, the website, its design, text and the packing calculations belong to us and are protected by intellectual property law. You may use PackBaby and print or copy your own lists for your own personal, non-commercial use. Please do not copy, resell, republish or systematically extract the service or its content, or use the PackBaby name or branding, without our written permission.
Please use PackBaby fairly. You agree not to:
If you break these rules we may suspend or close your account, as set out in section 11.
We work to keep PackBaby available and working properly, but it is provided by one person using third-party hosting and services, and we do not promise that it will be uninterrupted or error-free. It may be unavailable for maintenance, or because of a failure at a provider, or for reasons outside our reasonable control.
We may improve, change or withdraw features. If we make a change that significantly reduces what an active paid plan gives you, we will tell you and, if you are worse off as a result, you may cancel and we will refund a fair proportion of what you have paid for the part of the term you will not receive.
We may update these terms — for example to reflect a change to the service or to the law. The current version is always on this page, with the date it was last updated. If a change materially affects you, we will tell account holders by email before it takes effect. If you do not accept a change, you may stop using PackBaby and cancel, and the refund described in the paragraph above applies where the change leaves you worse off.
We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any of your rights as a consumer that cannot be excluded or restricted by law.
Subject to that:
You may have rights under the Consumer Rights Act 2015 and other consumer legislation — including that digital content must be of satisfactory quality, fit for purpose and as described, and that a service must be performed with reasonable care and skill. Nothing in these terms affects those rights. For a summary of your consumer rights, you can contact Advice Direct Scotland or Citizens Advice.
You can stop using PackBaby at any time, and can ask us to close your account by emailing support@packbaby.co.uk. Cancelling a PackBaby+ subscription is covered by our Refund & Cancellation Policy.
We may suspend or close your account if you seriously or repeatedly break these terms, if we are required to by law, or if we reasonably suspect fraud or misuse of the payment process. Unless the law prevents us, we will tell you why, and give you the chance to put things right where it is reasonable to do so. If we close your account and you have not broken these terms, we will refund a fair proportion of anything you have paid for a period you will not now receive.
If we stop offering PackBaby altogether, we will give active subscribers reasonable notice by email and refund a fair proportion of any unused part of the subscription term.
These terms are governed by the law of Scotland, and you and we can bring legal proceedings in the Scottish courts.
This does not take away your rights as a consumer. If you live in England, Wales or Northern Ireland, you keep the benefit of any mandatory consumer protection rules that apply where you live, and you may also bring proceedings in the courts of that part of the United Kingdom. If you live in Scotland, you may bring proceedings in the Scottish courts.
If something goes wrong, please contact support@packbaby.co.uk first — most problems are quickest to fix that way. Our complaints process is set out on our Support & Contact page.
